In response to the government's motion to dismiss the trial against Storm, its defense team submitted a reply last Friday, arguing that the case against him should be dismissed on the grounds that the government has not taken sufficient measures to prove Storm's active involvement in the alleged crimes stated in the indictment.
"In fact, as the government has acknowledged, when criminals start to abuse the Tornado Cash protocol, it is immutable and can be accessed by anyone with an internet connection," the motion said.
Most of the documents questioned the government's characterization of Tornado Cash as a "transfer business", which even caught the attention of Senators Ron Wyden and Cynthia Lummis, who wrote a letter opposing the government's interpretation of the term. This letter is also included in the motion of Storm. Storm's lawyers argue that categorizing Tornado Cash as a money transmission service "".
